Encroachment in California




In California, encroachment is illegal; it is the act of one person or entity making use of or occupying another person's land or property without the person's permission, consent, or legal right to do so. If someone is found to be illegally encroaching, they can be sued for detrimental encroachment. The remedies for a successful lawsuit in a court may include removing the encroaching structure, awarding compensation for damages, or an injunction to stop any further development of the land or property.

In California, if one constructs a building or a structure on someone's property without their consent this act would be regarded by the courts as encroachment. The statute of limitations is three years after the building is constructed in court. One can set up a land survey and this will make sure that there is no encroachment. If there is encroachment it will come in the land survey as they will mark the property boundaries exactly.
