Easement by Necessity


 Easement of Necessity happens when the entity wants to use the property but does not have permission from the owner to use it.

In this case, the aggravated individual files a petition in the court for the use of the property. Let's say there is a property in front of the entity property and in the middle is the road that connects the property to the main road, in this case, the entity can apply to the court for easement of necessity. The entity will ask the court to grant him permission to use the road that cuts in the middle of another person's property even if the property owner does not wish him to use the road on his property.
